How the rule works

  • Who it covers: bills from micro and small enterprises registered on Udyam as manufacturers or service providers. Medium enterprises and traders are outside it.
  • The deadline (MSMED Act s.15): the date you agreed in writing, never more than 45 days from the day you accepted the goods or service. With no written agreement, 15 days.
  • The tax hit (Income-tax Act 1961 s.43B(h)): if a bill is still unpaid at year end and its deadline has already passed, or it is paid after its deadline in the next year, the expense is added back this year and allowed only in the year you pay. The Income-tax Act 2025 carries a similar rule in s.37(2)(g).
  • Interest (MSMED s.16): compound interest with monthly rests at three times the RBI bank rate, from the deadline until payment. It is not tax-deductible (s.23).
  • This is an estimate for planning. Confirm the supplier's Udyam category and your figures with your CA before filing.
